Exalted Fitness Affiliate Program Terms and Conditions

1. Enrollment in the Program

1.1 By applying to become an affiliate of Exalted Fitness, you agree to be bound by these Terms and Conditions.

1.2 Exalted Fitness reserves the right to accept or reject any affiliate application at its sole discretion.

2. Affiliate Responsibilities

2.1 As an affiliate, you agree to promote Exalted Fitness products in a professional manner that aligns with our brand values.

2.2 You are responsible for ensuring that your promotional activities do not violate any laws or third-party rights.

2.3 Affiliates must disclose their affiliate relationship with Exalted Fitness clearly and conspicuously in all promotional content.

3. Commissions and Payments

3.1 Affiliates will earn a commission on qualifying sales made through their unique affiliate links.

3.2 Commission rates and payment terms will be outlined separately and may be subject to change at Exalted Fitness's discretion.

3.3 Payments will be made on a specified schedule (e.g., monthly) once a minimum commission threshold is met, as defined by Exalted Fitness.

4. Use of Intellectual Property

4.1 Affiliates may use Exalted Fitness's logos, trademarks, and marketing materials solely for the purpose of promoting Exalted Fitness products in accordance with these Terms and Conditions.

4.2 Affiliates must not modify or alter Exalted Fitness's logos or trademarks without prior written consent.

5. Termination

5.1 Either party may terminate the affiliate relationship at any time, with or without cause, by giving written notice to the other party.

5.2 Exalted Fitness reserves the right to terminate an affiliate's participation in the program if the affiliate violates these Terms and Conditions or engages in conduct that Exalted Fitness deems harmful to its brand or reputation.

6. Modification of Terms

6.1 Exalted Fitness reserves the right to modify these Terms and Conditions at any time by posting revised terms on its website or notifying affiliates via email.

6.2 Affiliates are responsible for regularly reviewing these Terms and Conditions to ensure compliance.

7. Limitation of Liability

7.1 Exalted Fitness will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with these Terms and Conditions or the affiliate relationship.

8. Governing Law

8.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

9. Entire Agreement

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
